Written Notice of Postponement of Sale (Civil Code §2924(a)(5)) A mortgage servicer is required to notify a borrower in writing within 5 business days following the postponement of a foreclosure sale, whenever the sale is postponed for at least 10 business days. This provision will sunset on January 1, 2018.This happens on a monthly basis for many who fact the threat of foreclosure.Unfortunately, there is little case law to clarify the consequences if this provision is violated. Presumably, it would trigger the injunction relief called out in the code and under CCP section 525-529. We hope you will contact us for your foreclosure litigation needs.
